Sec. 2250(A) Failure to Register/Update as Sex Offender — Elements is a federal statute that makes it illegal for a sex offender to fail to register or update their registration in any state where they live, work, or attend school. This applies to all sex offenders who are required to register in any state or local jurisdiction. In order to be found guilty under this statute, the following elements must be proved beyond a reasonable doubt: 1. The defendant was convicted of a qualifying sex offense; 2. The defendant was released from prison or otherwise changed status (e.g. moved to a new state, changed residence, etc.); 3. The defendant was required to register or update their registration in the jurisdiction in which they now reside; 4. The defendant knowingly and willfully failed to register or update their registration; The penalty for violating this statute is up to 10 years in prison and/or a fine of up to $250,000.
