Oklahoma Initiating an Appeal is a process whereby a party may challenge an unfavorable court decision. The appellant must file a written notice of appeal in the trial court to put the appeal into motion. There are five types of appeals that can be filed in Oklahoma: 1. Motion for New Trial: A motion for new trial is a request for the court to reconsider its decision based on new evidence or argument. 2. Commencement of Appeal: Once a notice of appeal is filed, the appellant must also file a record of the proceedings in the trial court. This is referred to as the commencement of the appeal. 3. Filing of Appeal Records: The appellant must then file a record of the proceedings in the appellate court. This record includes the briefs of the parties, as well as the transcripts of the testimony and evidence presented in the trial court. 4. Appeals by the State: The State of Oklahoma has the right to appeal any criminal or civil case in which it is a party. 5. Appeals Out of Time: If the appeal is not filed within the time limits set by law, the appellant may file an application for an extension of time.
