Oklahoma Using a Communications Facility to Commit a Felony is a felony offense that prohibits the use of any type of communications facility (i.e. telephone, computer, cellular phone, etc.) in order to commit a felony. This offense is punishable by up to 10 years in prison and a fine of up to $25,000. There are two types of Oklahoma Using a Communications Facility to Commit a Felony: 1) Using a Communications Facility to Facilitate the Commission of a Felony (21 O.S. § 817.1) and 2) Using a Communications Facility to Commit a Felony (21 O.S. § 817.2). The former requires that the defendant knowingly used a communications' facility to facilitate the commission of a felony, while the latter requires that the defendant used a communications' facility to actually commit a felony. In both cases, the defendant must have had the intent to commit a felony in order to be found guilty.
