The Lacey Act, 16 U.S.C. §§ 3371-3378 , protects both plants and wildlife by creating civil and criminal penalties for a wide array of violations. Most notably, the Act prohibits trade in wildlife, fish, and plants that have been illegally taken, possessed, transported or sold.

The 2008 Farm Bill amended the Lacey Act (16 U.S.C. §§ 3371-3378) and extended its protections to a broad range of plants and plant products, making it unlawful to import into the United States any plant or plant product that was illegally harvested.

Amphibians, reptiles, mollusks, and crustaceans were given protection under the act through an amendment in 1969. All fish and wildlife protected by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) were added to protections under the Lacey Act in 1975.

Penalties for violating the Lacey Act vary in severity based on the violator's level of knowledge about the illegal origin of the plant or plant product. Felony criminal penalties, including fines and imprisonment, may be imposed on those who traffic in plants or plant products that they know to be illegally harvested.
