The Massachusetts Domiciliary Foreign Personal Representatives Sworn Statement is a document used by the personal representatives of a deceased individual’s estate in Massachusetts who are located outside the United States. This statement is used to provide an oath of office, as well as to identify the foreign personal representatives and the estate of the deceased individual. This statement must be filed with the probate court in Massachusetts in order for the foreign personal representative to gain authority to administer the estate. There are two types of Massachusetts Domiciliary Foreign Personal Representatives Sworn Statement: (1) Executor or Administrator Sworn Statement; and (2) Foreign Executor or Administrator Sworn Statement. The Executor or Administrator Sworn Statement is used when the decedent’s will names an executor or administrator who is a US citizen. The Foreign Executor or Administrator Sworn Statement is used when the decedent’s will names an executor or administrator who is a foreign national.
