Illinois Warranty Deed Tenancy By The Entirety is a form of ownership of real estate available to married couples in Illinois. It is a form of co-ownership in which both spouses have a right to the entire property and an equal undivided interest in it. This form of ownership allows for automatic transfer of ownership to the surviving spouse upon death. It also provides certain protections against creditors of either spouse, as well as a degree of privacy in the event of dissolution of the marriage. There are two types of Warranty Deed Tenancy By The Entirety in Illinois: Tenancy by the Entirety with Right of Survivorship (TERM) and Tenancy by the Entirety with No Right of Survivorship (TEN). TERM allows the surviving spouse to be the sole owner of the property upon the death of the other spouse. TEN splits the property between the two spouses upon the death of one.
