California Advisement and Waiver of Rights (Felony) PC 1170(h) is a form used by the California courts to advise individuals charged with a felony offense of their rights and to obtain a waiver of those rights. The form includes advisement regarding the right to a jury trial, the right to confront witnesses, the right to remain silent, the right to have an attorney present during questioning, and the possible consequences of a plea of guilty or no contest. It also includes a waiver of the rights outlined on the form. There are three types of California Advisement and Waiver of Rights (Felony) PC 1170(h): Standard, Juvenile, and Non-English. The Standard form is used for adult felony cases; the Juvenile form is used for juvenile felony cases; and the Non-English form is used for cases where the accused does not speak English.
