Description

This form is for use by a Tenant to terminate a year-to-year non-residential lease. "Non-Residential" includes commercial, industrial, etc. Unless a written agreement provides otherwise, the Tenant does not have to have a reason for terminating the Lease in this manner, other than a desire to end the lease. A year-to-year lease is one which continues from year-to-year unless either party chooses to terminate. Unless a written agreement provides for a longer notice period, 60 days notice is required prior to termination in this state. The notice must be given to the Landlord within at least 60 days of the end of the current lease year. The form indicates that Tenant has chosen to terminate the lease, and states the deadline date (which is the end of the yearly term) by which the Tenant will vacate the premises. FAQ

Dear Tenant, I hope this letter finds you well. I am writing to provide you with a formal notice to vacate the rental property within _ _ days from the date of this letter. Please be aware that this notice holds legal significance and requires you to surrender possession of the property.

In calculating the 60 day notice period, do not count the day you serve the notice. For example, if you serve the notice on a Monday, then Tuesday is the first day. You need to count all days including weekends.

Texas law does not say how much notice must be given to a landlord if the lease is not a month-to-month lease. The amount of notice will depend on the terms of the agreement between the landlord and the tenant.

Be aware that if you are in a month-to-month tenancy, the landlord or tenant must only give 30 days' notice before the lease ends. If the lease term is more than one year, it must be in writing, or it is unenforceable.

There is no law regulating what kind of advance notice, if any, is required to stay on or vacate when the lease ends. On occasion a lease will state that it automatically renews unless either party gives notice otherwise. More frequently, a 30-day or 60-day notice must be provided by one party to the other.
