Appendix. 10.05 DEFINITIONS. (Rev 04/22) A. A public works contract is defined as “an agreement for the ion, construction, alteration, repair, or improvement of any public structure, building, road, or other public improvement of any kind,” (PCC § 1101).
The small project exemption applies for all public works projects that do not exceed: $25,000 for new construction, alteration, installation, demolition or repair. $15,000 for maintenance.

(b)(1) The retention proceeds withheld from any payment by a public entity from the original contractor, by the original contractor from any subcontractor, and by a subcontractor from any subcontractor thereunder shall not exceed 5 percent of the payment.
In California courts, a contractor standard of care is typically defined as “one who renders services in a professional or trade must exercise the skill and knowledge normally possessed by members of that profession or trade under similar circumstances at the same time and in the same locality”.

As noted, under BPC 7027.3, using someone else's contractor's license number for fraudulent purposes is illegal. This includes using the license number in an attempt to get around the licensing process and obtain a permit or contract without actually being licensed.
A company that hires an independent contractor is not responsible for tax withholdings, benefits, or workers' compensation coverage for the 1099 employee. The company is, however, responsible for paying the independent contractor for their services. An independent contractor can set their rates or fees.
California does not have a specific license option for handymen. A license may not be necessary if you only complete minor repairs or projects that will not become a finished part of the structure. Examples of handyman jobs that likely do not require a license: Hanging photo frames and artwork.
