The Certificate of Use, often known as a CU, confirms that the business is allowed in the zoning district where it is located.

The Notice of Commencement shall be recorded in the office of the Clerk where the real property is located. See Florida Statute 713 for detailed information, including posting requirements.

Pursuant to Chapter 28 of the Florida Statutes, the Clerk of the Circuit Court is the official recorder of all instruments that may, by law, be recorded in the county. The County Recorder's Office is responsible for the recording, protecting, preserving and disseminating of official records.

Submittals will be accepted using the Plans Status & Application Portal and/or in person. For in person submittals, documents will be converted into electronic format. The plan review will be completed electronically by multiple departments simultaneously, thus expediting the permitting process.

A Certificate of Occupancy (CO) is issued for new construction or change of use (i.e. from a school to a restaurant), while a Certificate of Completion (CC) is needed for remodels, renovations and shell buildings.

Documents are recorded at the Clerk of the Courts, MIAMI-DADE COUNTY RECORDER, COURTHOUSE EAST, 22 N.W. First Street, 1st Floor, Miami, FL 33128. You can record the Notice of Commencement by mail. The original Notice should be sent to the County Recorder, P.O. Box 011711, Flagler Station, Miami, Florida 33101.

Furthermore, a Certificate of Use is required for all businesses including new businesses, relocation of an existing business, new owner of business (transfer of ownership), and Rental of Apartment Units. Any change in use will require a new Certificate of Use.
