Description

There are various types of attorney fee arrangements such as time based, fixed, or contingent. Time based means a fee that is determined by the amount of time involved, such as so much per hour, day or week. Fixed means a fee that is based on an agreed amount, regardless of the time or effort involved or the result obtained. Contingent means a certain agreed percentage or amount that is payable only upon attaining a recovery, regardless of the time or effort involved.

With a contingent fee arrangement, the lawyer receives no fee unless money is recovered for the client. Upon recovery, the lawyer is paid an agreed-upon percentage, usually ranging from an amount equal to 25 to 50 percent of the amount recovered. A written fee agreement should specify the costs and expenses to be deducted and whether such costs and expenses are to be deducted before or after the contingent fee is calculated. Contingent fee agreements are generally not permitted for criminal cases or domestic relations matters.

Even if there is no recovery, however, the client is still responsible for court costs (filing fees, subpoena fees, etc.) and related expenses, such as telephone charges, investigators' fees, medical reports, and other costs.

The size and profitability of a law firm significantly impact partner salary, with equity partners at top firms enjoying impressive earnings that range anywhere from $3–$10 million—or for star partners, sometimes even more.

A PLLC is a specific type of LLC designed for licensed professionals in certain fields, such as doctors, lawyers, accountants, engineers, architects, and other regulated professions. In Texas, professionals must set up their business entities as professional entities.

A Limited Liability Partnership (LLP) in Texas is a type of business structure that offers limited liability to all partners. This means that a partner's personal assets are generally protected from the LLP's debts and obligations, even if another partner's negligence or misconduct causes financial losses.

With an LLC, anyone can be a member, or owner, of the business. State PLLC laws often provide that only licensed professionals can be members, or that a certain number of members must be licensed professionals. A PLLC cannot be used to shield the members from claims for malpractice.

Limited Liability Partnership > LLP Basic Concepts > Nature of Limited Liability Partnership (LLP)

Limited liability partnerships (LLPs) allow for a partnership structure where each partner's liabilities are limited to the amount they put into the business.

Disadvantages of an LLP Public disclosure is the main disadvantage of an LLP. Income is personal income and is taxed ingly. Profit can not be retained in the same way as a company limited by shares. An LLP must have at least two members. Residential addresses were historically recorded at Companies House.

Within the world of law firms, the highest position is a partner. It is arguably the pinnacle of their career for most lawyers. It is no small feat to achieve this and not many people can do it.
