OVERPAYMENT DEDUCTIONS The Payment of Wages and Fringe Benefits Act, Public Act 390 of 1978, as amended, allows a deduction for a wage or fringe benefit overpayment without the written consent of an employee, provided specific requirements are met.
Appeal Rights You have the right to appeal an overpayment determination. You must submit your appeal in writing within 30 days of the mailing date on the Notice of Overpayment (DE 1444). You can still submit an appeal after the 30-day deadline, but you must provide the reasons why you missed the appeal deadline.
In some situations, the UIA may send you actual bills for an overpayment. If this happens, you can use the same Financial Hardship waiver process. To do this, go to your MiWAM account and click on the Claimant Services Tab. Select “Request Restitution Waiver for Financial Hardship” and fill out the application.

You can file the protest electronically, by fax, or by mail, using the UIA's protest form. You must attach any documents you want the UIA to consider. The UIA will issue a redetermination of your claim. If you don't agree with this redetermination, you may appeal within 30 days.
An unemployment appeal hearing is similar to a court of law hearing, but it is not as formal, typically lasts less than an hour and is customarily conducted by telephone.
