Both applicants must be present to apply for a marriage license.
(e) To amend the marriage license, both parties are responsible for executing a notarized affidavit stating the error.

Texas Law. After marriage, you can take your spouse's last name without applying for a court order. Most organizations in the U.S. will accept a completed marriage license as legal proof of the name change. This is the case even if the marriage license lists your old name on it.
To apply for a marriage license, a man and a woman must each have a valid form of identification, such as a driver's license; a certified copy of a birth certificate; a passport or military identi- fication card; and their Social Security cards. Age requirements: You must be 18 years of age to marry on your own.
Licenses should be returned to our office for recording, after the ceremony has been performed. Return the license either in person to any location or by mail. Upon being returned to our office, original Marriage Licenses can take anywhere from 1-2 weeks to be returned to you.
If one or both parties to a marriage license discover an error on the recorded marriage license, both parties to the marriage shall execute a notarized affidavit stating the error.
