An Affidavit is a sworn statement which must be signed in front of a notary public. Effective January 1, 2024, notarized affidavits are no longer required for most sworn statements submitted in New York state court.Please complete all Parts of this form, including top right corner and check the State agency for which you are a provider. As of January 1, 2024, New York CPLR Rule 2106 is amended to permit that an affirmed statement can be used in a New York action instead of an affidavit. Such affidavit or sworn statement shall be admissible into evidence as an exhibit, if the statements therein are otherwise competent, relevant and material. The user of this affidavit agrees to hold the Department harmless for any and all claims which may arise as a result of completing this affidavit. If an address is in New York City, give the borough in addition to the city. If present address of applicant be in a village, give also the county. 7.
