First, including claims the provisional application can provide the benefit of an earlier “priority date” for the later-filed nonprovisional application and the claims that will eventually be examined in the nonprovisional application.
Foreign priority dates are not considered in determining the term of a patent. Here's a simple formula for calculating the expiration date of a US utility patent. Start with earliest filing date of a US nonprovisional, which may be a PCT application which is considered a US nonprovisional application.
(3) PRIORITY. —Priority under section 119, 365(a), 365(b), 386(a), or 386(b) shall not be taken into account in determining the term of a patent.
What is a priority date and why does it is matter? A. Priority date refers to the earliest filing date in a family of patent applications. If the earliest-filed patent application for a particular invention was a provisional application, then the filing date of the provisional is your priority date.
The term of every patent granted is 20 years from the date of filing of application. However, for application filed under national phase under Patent Cooperation Treaty (PCT), the term of patent will be 20 years from the international filing date ed under PCT.
The filing date is the date when a patent application is first filed at a patent office. The priority date, sometimes called the “effective filing date”, is the date used to establish the novelty and/or obviousness of a particular invention relative to other art.
(4) A provisional application is not entitled to the right of priority under 35 U.S.C. 119, 365(a), or 386(a) or § 1.55, or to the benefit of an earlier filing date under 35 U.S.C. 120, 121, 365(c), or 386(c) or § 1.78 of any other application. No claim for priority under 35 U.S.C.
The provisional application must include a description of the invention. While this description does not need to conclude with claims, the description must still meet the best mode and enablement requirements, which are briefly described in the BitLaw section on regular (non-provisional) patent applications.
Priority date refers to the earliest filing date in a family of patent applications. If the earliest-filed patent application for a particular invention was a provisional application, then the filing date of the provisional is your priority date.
The earliest filing date within a family of patent applications is referred to as the priority date. The priority date would be the filing date of the sole application when just one patent application is involved.
