Sec. 5.001. SALE, CONVEYANCE, OR ENCUMBRANCE OF HOMESTEAD. Whether the homestead is the separate property of either spouse or community property, neither spouse may sell, convey, or encumber the homestead without the joinder of the other spouse except as provided in this chapter or by other rules of law.

The Homestead Act, enacted during the Civil War in 1862, provided that any adult citizen, or intended citizen, who had never borne arms against the U.S. government could claim 160 acres of surveyed government land. Claimants were required to live on and “improve” their plot by cultivating the land.

To qualify for the general residence homestead exemption, a home must meet the definition of a residence homestead and an individual must have an ownership interest in the property and use the property as the individual's principal residence.

There is no limit to the value of urban or rural homesteads, only to their size. Rural homesteads are limited to 200 acres for a family and 100 acres for a single adult, including improvements on the property. An urban homestead is limited to ten acres with improvements, which must be in adjacent lots.

But a vacant lot can be homestead if the owner has reasonable expectations of building a home on it; a leasehold estate (rental property) can be homestead; a life estate may also qualify; and even a beneficial interest in a trust that holds real estate can be homestead.

Local taxing units offer partial and total exemptions from a qualifying property's appraised value. A partial exemption removes a percentage or a fixed dollar amount of a property's value from taxation. A total exemption excludes the property's entire value from taxation.
