This law increased the annual Texas homestead tax exemption from $40,000 to $100,000, starting with January 2023 taxes. While tax savings relief stole the headlines, another law was enacted that may require homeowners to renew their application for their homestead exemptions every five years.
To protect the value of your property up to one million dollars ($1,000,000) per residence, per family, you must file a document called a “Declaration of Homestead”. You can file this form at the Registry of Deeds in the county or district where your property is located, referencing the title/deed to the property.
As stated above, if you are a homeowner whose primary residence is a property in Massachusetts, you automatically receive up to $125,000 in Homestead Exemption protection. Anyone who owns and occupies a primary residence in Massachusetts may apply for additional Homestead Exemption protection.
REQUIRED DOCUMENTATION Attach a copy of each property owner's driver's license or state-issued personal identification certificate. The address listed on the driver's license or state-issued personal identification certificate must correspond to the property address for which the exemption is requested.
Homestead declaration protects you from unsecured creditors and certain other debts or attachments, but it does not shield you from first or second mortgage lenders and/or equity lenders who possess a security interest in your home.
Requirements of the Homestead Act Land titles could also be purchased from the government for $1.25 per acre following six months of proven residency. Additional requirements included five years of continuous residence on the land, building a home on it, farming the land and making improvements.
So finally, in 1862, the Homestead Act was passed and signed into law. The new law established a three-fold homestead acquisition process: file an application, improve the land, and file for deed of title.
