An employee who works 5 days per week is entitled to 30 days every 36 months. An employee who works 6 days per week is entitled to 36 days' sick leave every 36 months. Where an employee works Monday to Friday plus every second Saturday, the employee is entitled to 33 (30 + 3 Saturdays) days' sick leave.

Basic Conditions of Employment Act (BCEA) This Act relates to the working conditions of employees by providing standard / basic conditions of employment. Some terms covered by the Act include leave, overtime, hours of work, etc.

At arbitration or Labour Court the arbitrator or judge hears evidence from the employer and employee and decides whether the dismissal or other act was fair or not. Once an arbitrator has communicated his/her decision to the parties either of them may, if dissatisfied, apply for a review at the Labour Court.
