Sri Lankan labour law is a complex web of legislation dating over 50 years. Most of these laws aim to protect the interest of the employees over seeking to achieve a balance between the competing interests of employers and employees.

For example, under the TEWA, the calculation is as follows: For the first 5 years of service, it's 2.5 months of salary for each completed year. For the 6th to 14th year of service, it's 2 months of salary for each completed year. For the 15th to 19th year of service, it's 1.5 months of salary for each completed year.

Effective July 1, 2024, the salary threshold will increase to the equivalent of an annual salary of $43,888 and increase to $58,656 on Jan. 1, 2025. The July 1 increase updates the present annual salary threshold of $35,568 based on the methodology used by the prior administration in the 2019 overtime rule update.

Labor Law 240 protects workers who have been severely injured and would otherwise not be able to obtain compensation to cover the damages and expenses related to their accident.

New York City's Labor Law 200, applying to laborers such as construction workers, describes the duty of employers and construction site owners “to protect the health and safety of employees” by assuring them of “reasonable and adequate protection” for any type of work they have been hired to perform.

Section 240 of New York State Labor Law, the “Scaffolding Law”, protects the rights of construction workers who suffer a fall or are struck by a falling object. This legal requirement mandates construction owners and contractors to provide scaffolding and other safety measures to protect workers.

The proposed new 'Employment Act' – In this context the Ministry of Labor has commenced a comprehensive review of Sri Lanka's Labor laws. It is intended that revised legislation takes the form of a unified 'Employment Law' to facilitate the more efficient use and implementation of legislation in the industry.
