Some employers may expect as many hours of work from their salaried employees as it takes to perform the job well, but exempt salaried employees have typically contracted to work between 40 and 50 hours per week.

Employers Cannot Deny Breaks for Salaried Employees Under New York labor laws, public and private employees are entitled to meal breaks. Non-factory workers are entitled to a 30-minute lunch break during their first shift. A midway break needs to be at least 45 minutes.

Instead, employers must adhere to the requirements of the federal Fair Labor Standards Act (FLSA), which also does not mandate a meal or rest break. Thus, in Florida, an adult employee does not have a legal right to a meal period or break.

As a salaried exempt employee, you must make at least double the yearly amount that a minimum wage hourly worker would make working a 40-hour work week each week. What Are the Key Changes? Changes are meant to reflect inflation and increased living costs.
