FAQ

After a summons with notice is served, the defendant will demand that the plaintiff serve a complaint. The plaintiff must then have the complaint served within 20 days after being served with the demand, or the case may be dismissed.

You start a lawsuit by filing a complaint. In some circumstances, you file a petition or a motion. The court has several complaint forms that you may use in drafting your complaint. The forms are available online and at the Pro Se Intake Unit.

You may choose to file your own Family Court petition. To do so, go to the website listed below and choose the type of petition you want to file. Completed petitions must be filed with the General Clerk of the Family Court (631-853-4289).

Any party may move for summary judgment in any action, after issue has been joined; provided however, that the court may set a date after which no such motion may be made, such date being no earlier than thirty days after the filing of the note of issue.

The Suffolk County Supreme Court is located in Riverhead and Central Islip. While Matrimonial and Guardianship proceedings take place predominately in our Central Islip location, all other Civil matters are heard in Riverhead.

As per CPLR 3212(b), a motion for summary judgment must be supported by an affidavit. This affidavit should be from someone with knowledge of the facts, recite all material facts, and demonstrate the absence of a defense or the lack of merit in a cause of action or defense.

A moving party will now be required to file their motion and accompanying documents 81 days, rather than 75 days, before the hearing, opposition will be due 20 days before the hearing rather than 14, and the reply brief must be filed 11 days before the hearing rather than just 5 days.
