Rule 3212. Motion for summary judgment. (a) Time; kind of action. Any party may move for summary judgment in any action, after issue has been joined; provided however, that the court may set a date after which no such motion may be made, such date being no earlier than thirty days after the filing of the note of issue.

Once the summary judgment is granted, the case ends there, and neither party will have to deal with the stresses of a full trial. At times, the winning party can ask for an award of costs or attorney fees from the other party unless those terms were already established in the summary judgment.

The Suffolk County Supreme Court is located in Riverhead and Central Islip. While Matrimonial and Guardianship proceedings take place predominately in our Central Islip location, all other Civil matters are heard in Riverhead.

A motion for summary judgment must be supported by affidavit, a copy of the pleadings, and any other available proof, such as depositions and written admissions. CPLR 3212 (b) (amended eff 5/7/22).

A Motion for Summary Judgment can be filed by any party in a lawsuit (defendant or plaintiff) who wants the Court to enter a final judgment on all or some of the parties' claims or defenses before trial. The Motion for Summary Judgment is governed by Federal Rule of Civil Procedure 56.

Serving “Notice of Entry” Once the judgment is entered, the winner should serve a copy of the judgment with “notice of entry” on the loser. This service starts the loser's time to appeal running.

A judgment is good for 20 years, but if the plaintiff wants to enforce the judgment against land it is only good for 10 years unless the plaintiff renews it for another 10 years.
