FAQ

The Hospital Lien Act “compensates a hospital for providing medical services to an injured person by giving the hospital a direct right to a certain percentage of specific property, i.e., a judgment, compromise, or settlement, otherwise accruing to that person.” Newton v. Clemons, (2003) 110 Cal. App. 4th 1, 14.

When a person is injured in an accident and seeks medical treatment, healthcare providers may agree to defer payment until the injured party receives compensation from their personal injury case. This deferred payment is known as a medical lien.

You do not have to have a contract to file a mechanic's lien. However, you do need to be a licensed contractor. If you are licensed, then you can record the lien within 90 days of finishing the project, regardless of whether you had a written contract.

A lien expires 10 years from the date of recording or filing, unless we extend it. If we extend the lien, we will send a new Notice of State Tax Lien and record or file it with the county recorder or California Secretary of State. We will not release expired liens.

Tells all parties in a case that a lien is created against any judgment or settlement in the case by a judgment or order in another case. Get form EJ-185.

To do this, fill out an EJ-001 Abstract of Judgment form and take it to the clerk's office. After the clerk stamps it, record it at the County Recorder's Office in the county where the property is located. Place a lien on a business.

The potential lien claimant must record the mechanics lien within 90 days of: Completion of work, • When the owner began using the improvement, or • When the owner accepted the improvement. If the potential lien claimant fails to record the mechanics lien within the appropriate time frame, the lien isn't valid.

California's statute of limitations for contractual medical liens is four years. This gives medical providers four years from the date of the lien agreement to take legal action to collect on it.
