Expungement is a type of relief to help clean up a person's prior criminal record. This relief is available to people with certain misdemeanor and felony convictions in California. To be eligible for expungement, the person must not be serving any other sentence or be charged with any other crime.

The procedure will take from 10 to 16 weeks (and sometimes longer) depending upon the Court, the complexity of the case, and how old the conviction is. Felony convictions are not automatically expunged with the passage of time but require the filing and granting of an Expungement Petition by the Court.

Comply with Local Rule 3116, which provides that a written response to any OSC be filed with the Court at least 5 days in advance of the hearing (although the Court encourages filing any response at least 10 days in advance of the OSC where possible).

Pursuant to Local Rule 3118, eFiling is mandatory for parties represented by counsel. Ex Parte applications shall be submitted over eFiling through your selected Electronic Filing Service Provider (EFSP). See the Court's General Order 2022-1, section 9 for more information about ex parte application submissions.

This rule is essentially forcing parties to try to settle issues in their case before going to trial. If Local Rule 5153 is not complied with, the Court will not allow your case to go forward until these procedures are met.

If the request is made less than 5 court days before the hearing on the Petition, an Ex Parte Application is required to seek a continuance, or the party may appear at the scheduled hearing and request a continuance. There is no guarantee that the judge will grant your request for continuance at the hearing.

An applicant must make an affirmative factual showing in a declaration containing competent testimony based on personal knowledge of irreparable harm, immediate danger, or any other statutory basis for granting relief ex parte.

There are allegations of child neglect, physical abuse, or sexual abuse. There is credible evidence proving the other parent is guilty of domestic violence. The parent refuses to allow the petitioning parent to exercise visitation or see their child.
