However, not all retirement plans are covered by ERISA. For example, Federal, state, or local government plans and some church plans are not covered.

Retirement plans and other benefits subject to ERISA ERISA also applies to employer-sponsored retirement plans. This includes defined benefit plans—which promise a monthly benefit upon retirement—and defined contribution plans—such as a 401(k). This includes the following types of retirement benefits: Pension plans.

In general, ERISA does not cover plans established or maintained by governmental entities, churches for their employees, or plans which are maintained solely to comply with applicable workers compensation, unemployment or disability laws.

Employee benefit plans maintained by governmental employers are exempt from ERISA's requirements. This exemption includes plans maintained by the federal, state or local (for example, a city, county or township) governments.

ERISA protects employees who participate in certain health and retirement plans at private organizations. The law applies to many types of employers, including sole proprietorships, S corporations, C corporations, limited liability companies, and partnerships.
