If you want to file a motion, the process is generally something like this: You write your motion. You file your motion with the court clerk. The court clerk inserts the date and time your motion will be heard by the judge. You “serve” (mail) your motion to the other side.

The procedure to establish contempt is straightforward. The person seeking the finding must file a motion in court with supporting documents stating how a court order was allegedly violated. The court will set a hearing date. The accused party must be properly served with the motion and notice of hearing.

You must complete and submit an original and two copies of the enclosed complaint form as well as the Civil Cover Sheet. You should also keep an additional copy of any document filed with the Court for your own records. All copies of the complaint must be identical to the original.

Cases which involve more than $20,000 must be filed in the Law Division of the Superior Court. Generally, you can present your case without an attorney, unless you are a corporation, in which case you must be represented by counsel or your case will be dismissed.

If the docket number begins with a “J,” the warrant should be filed in the county where the judgment was obtained. If the judgment was docketed as a statewide lien and has a docket number that begins with “DJ,” the warrant should be filed with the Superior Court Clerk's Office in Trenton.

The costs for filing a complaint in Special Civil are: $50 for a complaint where the amount claimed is $5,000 or less. $75 for a complaint where the amount claimed is more than $5,000. $5 for each additional defendant.
