Directory information is information in a student's education record that may be disclosed to outside organizations without a student's prior written consent. Directory information includes student's name, address, telephone number, email, date and place of birth, honors and awards, and dates of attendance.
Conditions of Disclosure to Third Parties. The general rule under the Privacy Act is that an agency cannot disclose a record contained in a system of records unless the individual to whom the record pertains gives prior written consent to the disclosure. There are twelve exceptions to this general rule.
Some examples of information that MAY NOT BE RELEASED without prior written consent of the student include: university ID number. Social Security number. birthdate. grades/exam scores. GPA. current class schedule. parent name and address. race/ethnicity.
Furthermore, schools may disclose, without consent, directory information, which FERPA defines as a student's name, address, telephone number, date and place of birth, honors and awards, and dates of attendance.
Invasion of Privacy: Public Disclosure of Private Facts.
Information compiled in reasonable anticipation of a civil action proceeding. Material reporting investigative efforts pertaining to the enforcement of criminal law including efforts to prevent, control, or reduce crime or to apprehend criminals.
Employment NDA agreement violations. It's illegal to reveal trade secrets or sensitive company information to a competitor. It can carry legal consequences, including fines and even jail time — even if you didn't sign an NDA.
“No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains subject to 12 exceptions.”
An NDA requires the recipient to take reasonable measures to keep the information confidential and prohibits each recipient from disclosing it to any unauthorized party. This way, your information is only used by those who you want to use it, and then only for the purposes you want it used for.
NDAs are enforceable when they are signed — if they are properly drafted and executed. NDAs are enforceable once signed, provided they have been drafted and executed properly. Unilateral NDAs need only the signature of the receiving party, whereas mutual non-disclosure agreements need the signatures of both parties.
