The law contains 30 exceptions, cited in Section 708, that permit an Agency to withhold records. An Agency may deny release of a record if it falls within one of the 30 exceptions designed to protect information that is confidential or may jeopardize safety or investigations.
Section 708. Exceptions for public records. (1) The burden of proving that a record of a Commonwealth agency or local agency is exempt from public access shall be on the Commonwealth agency or local agency receiving a request by a preponderance of the evidence.
When two vehicles approach or enter an intersection from different roadways at or about the same time, drivers coming from the left must yield to vehicles coming from the right. A vehicle entering a public highway from an alley, private road, or driveway must wait until the main road is clear.
Section 703, 65 Pa. C.S.A. Section 707 identifies the three (3) exceptions to the requirement of open meetings, which are: executive session, conference and certain working sessions. Executive sessions tend to be the most common exception to open meetings.
The Right-to-Know Law defines "requester" as "a person that is a legal resident of the United States and requests records pursuant to this act." Thus, any legal resident of the United States can file a request under the RTKL.
The RTKL allows an agency to deny access to records; it does not require it to do so. An agency has the discretion to release records that it could otherwise withhold under the RTKL's exemptions. However, it should be noted that other confidentiality laws could impact what records an agency can legally release.
