The protected party must demonstrate it is more probable than not there is a sufficient risk of future abuse to find the protected party's apprehension is genuine and reasonable. If the protected party can meet their burden of proof, the restrained party will have to show there is no reasonable apprehension.
A temporary restraining order (TRO) in California legally requires someone to immediately stop threatening, abusive, or violent actions and stay away from protected individuals. TROs provide emergency protection from further harm and can be issued by a judge given reasonable proof of past or imminent danger.
If a judge is unwilling to grant the TRO, that essentially means that the petitioner has not made a reasonable primafacie case of harassment or abuse, and does not bode well for the petitioner's case.
Evidence for a Temporary Restraining Order In California, the threshold for obtaining a TRO is quite low, and the accused, referred to as the respondent, is often not even present to raise a defense. To obtain a TRO, the petitioner must typically only submit sworn statements detailing the alleged abuse or harassment.

For a person to obtain a TRO, that person must go to court and fill out the required paperwork explaining to the judge what occurred and why that person needs a restraining order. This person can ask the judge to issue a Temporary Restraining Order without notifying the other party.
Using the facts of the incident only, keep your statement brief and to the point. Briefly describe the most recent incident of abuse and/or threats of abuse or other behaviors. Focus on the actual behavior. Do not include prior incidents, (that will be the next paragraph).
You must file the request for order to set aside within 6 months after you found out about or should have found out about the fraud. Include a proposed response. This is the response you would have filed if you had acted in time before the order or judgment was made against you.
