FAQ

SERIOUS PHYSICAL INJURY means impairment of a person's physical condition which creates a substantial risk of death, or which causes death, or serious and protracted disfigurement, or protracted impairment of health or protracted loss or impairment of the function of any bodily organ.

The three more common scenarios involving a Third Degree offense include Embezzlement type schemes and employee-employer related thefts, Identity Theft or related frauds, and situations where the accused simply takes property that he or she was not entitled.

Because assault in the third degree is a class A misdemeanor the maximum possible sentence is up to 1 year in jail. In lieu of being sentenced to jail, the judge may sentence to you to a 3 year probation term.

3rd Degree Felony Assault A 3rd degree Felony has a punishment range of anywhere from 2-10 years in jail with a fine not to exceed $10,000.

Assault in the Second Degree is a “D” violent felony and is therefore punishable by time in state prison – a presumptive mandatory two years up to seven years or five years probation. Assault in the First Degree is a “B” violent felony with a sentence up to 25 years in prison and a minimum of five years in prison.
