FAQ

The 1980's saw a legislative and judicial crackdown on drunken driving. Citizen groups such as Mothers Against Drunk Driving lobbied for strict enforcement of drunk driving laws, arrests for drunk driving increased, and all 50 States raised the drinking age to 21.

Drunk driving suspects can expect to spend at least two hours answering questions, being fingerprinted and photographed, and submitting to chemical testing of the driver's blood alcohol content (BAC). A driver could spend a few hours before they are released, or it may take up to a few days.

Most people are surprised to learn that on September 10, 1910, New York was the first state to pass drunk driving laws. California soon followed with its own laws. However, these early laws merely made it illegal to drive while under the influence of alcohol.

118 years ago on September 10, 1897, a 25-year-old London taxi driver named George Smith was the first person ever arrested for drunk driving. Smith slammed his cab into the side of a building and later pled guilty to driving drunk and was fined only 25 shillings.

If law enforcement catches you driving with drugs or alcohol in your system that exceeds the legal limit, you may be charged with driving under the influence—also known as a DUI or Operating Under the Influence, also known as OUI.

Best Case. If you have been pulled over for allegedly driving under the influence, the best-case scenario you could hope for is that the officer(s) failed to gather enough evidence against you or made procedural, technical, or constitutional mistakes before, during or following your arrest.

Drivers may end a case in a matter of days if they plead guilty or immediately accept a plea bargain offered by the prosecution. DUI cases that go to trial can take over a year to resolve in some cases. DUI cases are often broken up into different stages.

The punishment for a first DUI varies by state but often includes fines, license suspension, probation, mandatory alcohol education, and possibly community service. Jail time is rare for first offenses but may apply in cases of high blood alcohol content or accidents.

What Time of Day Do Most DUI Arrests and Accidents Occur? While DUI arrests and accidents can occur at any time of day, there are some hours when there is a higher risk of encountering a driver under the influence. The period of time from midnight to AM is the most dangerous time to be on the road.
