For example, in December 2021, Congress raised the debt ceiling from $28.9 trillion to $31.4 trillion, allowing borrowing to proceed until the total government borrowing reached this new limit (which finally happened on January 19, 2023).

The amendment was limited by the fact that the Supreme Court largely ignored the Black Codes and did not rule on them until the 1950s and 1960s, almost a century after they were passed.

Without the enforcement clause, the provisions of the Fourteenth Amendment would be moot. This clause gives Congress the power to pass legislation with the goal of enforcing the Amendment. As a result, Congress has used this clause to ensure all Americans enjoy the rights outlined in the Fourteenth Amendment.

Procedural due process refers to the constitutional requirement that when the government acts in such a manner that denies a citizen of life, liberty, or property interest, the person must be given notice, the opportunity to be heard, and a decision by a neutral decision-maker.
