FAQ

If the OPT is approved, USCIS will issue an Employment Authorization Document (EAD). The student must not begin working before the start date on the EAD.

Your Green Card (Form I-551, Permanent Resident Card) is evidence of your employment authorization. You also do not need to apply for an EAD if you have a nonimmigrant status MJM1 that authorizes you to work for a specific employer incident to your status (for example, you are an H-1B, L-1B, O, or P nonimmigrant).

Unlike a work visa, it costs nothing for an employer to hire someone with an OPT work permit. OPT is thus not a work visa, but you retain your F-1 status as a student when you participate in the program.

You will be reporting and updating your employment information in the SEVP Portal. The SEVP Portal allows OPT students to report their address, telephone number and employer information. The portal shares information with SEVIS, but does not give students direct access to SEVIS.

You must be physically present in the US at the time you submit your OPT application.

You are still considered to be in F-1 student status while on OPT and will continue to use your F-1 visa stamp for any travel during your OPT period. To maintain status on OPT, you must either work at job(s) directly related to your major/level of study or actively seek employment in your major/level of study.

Approximately 8 to 20 Weeks After Filing If you also submitted Form I-765, Application for Employment Authorization, USCIS is currently issuing an Employment Authorization Document (EAD) in approximately 8 weeks. Many people call it a work permit.

During the 24-month extension, you must carry the following documents in order to return to the U.S.: STEM OPT Employment Authorization (EAD) card. STEM OPT Form I-20 form with a valid travel signature (valid for six months)

Travel While OPT or OPT STEM Extension is Pending Travel during the OPT application process is allowed, but not recommended as it poses certain risks.

You cannot begin work until you have the EAD card in your possession. You should receive the card in 2-4 weeks. If you do not receive the EAD card within 30 days of the approval, you should contact USCIS.
