The probate process in Maryland typically takes about one year in most straightforward estate administration cases. In cases where there may be family disputes or other ambiguity, the administration of the estate can take much longer.
In Maryland, a will must be (1) in writing (typed or handwritten), (2) signed by the person making the will, and (3) attested and signed by two credible witnesses in the presence of the person making the will. The person making the will and the two witnesses must be at least 18 years of age and legally competent.
Priority of appointment begins with person(s) named in the will to serve, surviving spouse, children, etc., to creditors or any other person. Maryland law has established restrictions on the right to letters of administration.
Within 12 Months from the date of appointment of the personal representative, final distribution of the estate shall be made. Final distribution may be made later if the personal representative has obtained extensions to the filing of the Final Report.
