Description

This form is used by a Landlord to demand payment of overdue rent from a non-residential tenant within 5 days from giving the Notice in accordance with the laws of your state. (Note: If a written agreement provides for a longer notice, use the notice length stated in the agreement). "Non-Residential" includes commercial or industrial property. If the Tenant fails to pay within 5 days, the lease may be considered terminated by the Landlord. The Tenant is informed that the Tenant must either pay the rent or suffer possible termination. If he does not pay, the Landlord may begin eviction proceedings. If the Landlord does not elect to proceed with termination or eviction, but instead agrees to accept rent after the termination date stated in the Notice, the lease is generally reinstated. The landlord must give the tenant notice and go through the court process to get an Eviction Order. Then they must get the Sheriff to remove the tenant from the unit. The landlord cannot change the locks or remove the tenant's property until the Sheriff enforces the Eviction Order.

The non-payment notice gives the tenant a total of five (5) days to either pay all that is due to the tenant or leave the property along with their possessions. If the tenant decides to leave, they shall be liable for the entire amount past due plus any other obligations that were in the lease agreement.

Landlords may give a tenant a 5-day notice if the tenant fails to pay rent and 10-day notice for material non-compliance with the lease.
