In Georgia, an owner has the option of recording or causing its agent or contractor to record with the Clerk of the Superior Court in the county where the project is located a Notice of Commencement no later than 15 days after the contractor physically starts work on the property. The Notice of Commencement contains information relevant to the lien rights of potential lien claimants on the project, and should include the following:


" The name, address and telephone number of the contractor;

" The name and location of the project being constructed and the legal description of the property upon which the improvements are being made;

" The name and address of the true owner of the real property;

" The name and address of the person other than the owner at whose instance the improvements are being made, if not the true owner of the real property;

" The name and address of the surety for the performance and payment bonds, if any; and

" The name and address of the construction lender, if any.


To be effective, a copy of the Notice of Commencement must be posted at the project site throughout the duration of the project. The posting should be in a conspicuous location.
