La fuerza mayor es la circunstancia exterior, imprevisible o inevitable que afecta el cumplimiento de obligaciones. Es un motivo que libera de la responsabilidad contractual o extracontractual alterada por el hecho.

Caso fortuito implica un evento de la naturaleza que es impredecible. Fuerza mayor implica un evento causado por el hombre que es inevitable.

De conformidad con lo dispuesto en el articulo 45 del Codigo Civil, se llama fuerza mayor o caso fortuito el imprevisto a que no es posible resistir como un naufragio, un terremoto, los actos de autoridad ejercidos por funcionarios publicos, etc.

La fuerza mayor solo se demuestra: '... mediante la prueba de un hecho externo y concreto (causa extrana). Lo que debe ser imprevisible e irresistible no es el fenomeno como tal, sino sus consecuencias...

- Se llama fuerza mayor o caso fortuito, el imprevisto a que no es posible resistir, como un naufragio, un terremoto, el apresamiento de enemigos, los actos de autoridad ejercidos por un funcionario publico, etc.

Comunmente se llama "caso fortuito" a lo que acontece inesperadamente, o sea a lo "imprevisible"; la fuerza mayor alude a lo irresistible, es decir lo "inevitable". Desde el punto de vista de los efectos juridicos, en la medida que ambos conceptos se esten asimilados legalmente, no existiria distincion entre ambos.

Para que se constituya la fuerza mayor o el caso fortuito, ademas de acreditar que el hecho fue imprevisible, se debe acreditar que tal circunstancia imprevista tuvo consecuencias irresistibles, que no se pudieron superar.

La fuerza mayor o caso fortuito es una eximente de responsabilidad, que consiste en cualquier evento externo que por sus caracteristicas de imprevisibilidad e irresistibilidad - impide el cumplimiento del deudor o la produccion de un dano.

AL EFECTO CABE SENALAR QUE EL ARTICULO 45 DEL CODIGO CIVIL DISPONE: "SE LLAMA FUERZA MAYOR O CASO FORTUITO EL IMPREVISTO A QUE NO ES POSIBLE RESISTIR, COMO UN NAUFRAGIO, UN TERREMOTO, EL APRESAMIENTO DE ENEMIGOS, LOS ACTOS DE AUTORIDAD EJERCIDOS POR UN FUNCIONARIO PUBLICO, ETC.".
