Parties entering an agreement to create a partnership or become partners at a future time or on the happening of a contingency do not actually become partners until the time has passed or the contingency has occurred. The parties would not be subjected to any of the partnership legislation of the specific jurisdiction prior to commencement of the valid partnership, but any provisions that would continue to operate after the partnership commences to function must be drafted to remain within the applicable statutory provisions regulating partnerships.
