En primer lugar, hay que tener en cuenta que no es posible renunciar a la herencia antes del fallecimiento de una persona. El Codigo Civil dispone claramente que nadie puede renunciar a una herencia sin estar cierto de la muerte de la persona a quien haya de heredar y de su derecho a la herencia.

La renuncia a la herencia solamente se puede realizar una vez fallecido el testador, ademas de formalizarse en escritura publica, por lo que hay que acudir al notario. La renuncia tiene un coste modico de unos 50 o 60 euros.

El Codigo Civil establece que no cabe la renuncia parcial, es decir, no se puede renunciar a una parte de la herencia y a otra no. Es decir no es posible renunciar simplemente a las deudas en el caso de que las hubiese y beneficiarse del resto, se hereda todo o nada.

Al margen de los motivos que llevan al desestimiento, lo que si hay que tener claro es que no se puede renunciar a una herencia en vida. El Codigo Civil dispone que no se puede proceder sin tener la certeza del fallecimiento de la persona que ostenta la titularidad de los bienes.

Cuando alguien muere, dejan un patrimonio que debe ser liquidado (manejado). Eso significa colectar la propiedad de la persona, pagar sus deudas, y distribuir lo que sobre. La distribucion puede hacerse de acuerdo a un testamento valido, o, si no existe un testamento, a traves de la ley de herencias de Illinois.

En caso de que se opte por renunciar a la herencia, la parte de la renuncia se repartira entre el resto que tengan el mismo parentesco con el fallecido. Si tambien renuncian los herederos con el mismo parentesco, se pasara a sus hijos, y asi de manera sucesiva.

Al igual que la mayoria de los procesos relacionados con testamentos o sucesiones intestadas, la renuncia de herencia debe expresarse a traves de una escritura publica ante notario o en acta otorgada ante el juez al que corresponda validar la sucesion, la misma que se debe inscribir en los Registros Publicos.
