Una vez otorgada la sucesion intestada o reconocido el testamento, el heredero podra inscribir el inmueble en la Sunarp de acuerdo a los requisitos establecidos por ley. El Codigo Civil establece que no cabe la renuncia parcial, es decir, no se puede renunciar a una parte de la herencia y a otra no. Es decir no es posible renunciar simplemente a las deudas en el caso de que las hubiese y beneficiarse del resto, se hereda todo o nada.

¿Como se hace? Una vez aceptada la herencia, se renuncia a la misma, gratuitamente o por precio, a favor de uno de los coherederos o a favor de terceros a traves de un documento publico ante notario o en un documento privado.

A diferencia de la aceptacion de herencia que puede ser tacita o efectuada mediante documento privado, la renuncia de herencia debe ser afectada ante notario a traves de una escritura publica. La renuncia debe ser total, no se puede renunciar especificamente a la herencia .

En caso de que se opte por renunciar a la herencia, la parte de la renuncia se repartira entre el resto que tengan el mismo parentesco con el fallecido. Si tambien renuncian los herederos con el mismo parentesco, se pasara a sus hijos, y asi de manera sucesiva.
