17 de la Ley 820 de 2003. El cedente es el arrendatario que transfiere mediante la cesion del contrato de arrendamiento a otra persona que adquiere la denominacion de arrendatario, o sea el cesionario.
El desistimiento del inquilino se encuentra regulado en el articulo 11 de la Ley de Arrendamientos Urbanos (LAU). El arrendatario podra desistir del contrato de arrendamiento, una vez que hayan transcurrido al menos seis meses, siempre que se lo comunique al arrendador con una antelacion minima de treinta dias.
"La cesion del contrato sera valida cuando lo autorice el arrendador o sea consecuencia de la enajenacion del respectivo establecimiento de comercio."
El traspaso o cesion de local de negocio consiste, fundamentalmente, en sustituir al actual arrendatario (inquilino) por uno nuevo, manteniendose iguales las demas condiciones del contrato de arrendamiento del local.
Como en un contrato de alquiler hay dos partes, arrendador y arrendatario o, lo que es lo mismo, propietario e inquilino, respectivamente, puede pasar que sea el arrendatario el que cambie o, por el contrario, el propietario.
Para que se produzca esta cesion es necesario el consentimiento expreso y por escrito del arrendador a traves de un anexo de contrato de alquiler. Este anexo de contrato de alquiler ha de tener la firma del nuevo inquilino, la del antiguo y la del arrendador del inmueble.

Y, en cualquier caso, la cesion debe hacerse firmando un otrosi del contrato donde se especifique el cambio, o hacer un nuevo contrato.
