Description

The Personal Care Policy in Massachusetts outlines a caregiver's service agreement between a client and a caregiver, detailing the terms of assistance that the caregiver will provide. This agreement covers essential elements such as the activities of daily living, medication scheduling, mobility assistance, and additional services as agreed upon by both parties. The schedule for services must be mutually established and alterations require a minimum of 48 hours advance notice. Notably, either party may terminate the agreement with two weeks' written notice. This document makes clear that the caregiver is an independent contractor without the authority to bind the client legally. The agreement addresses potential breaches and allocates responsibility for legal costs incurred due to disputes. It offers flexibility in hours and compensation, with provisions for negotiation. This form is particularly useful for attorneys, partners, owners, associates, paralegals, and legal assistants in ensuring compliance with Massachusetts laws. It provides a structured approach to establishing a caregiving arrangement, safeguarding both parties' rights and expectations.

Massachusetts' passage of health care reform legislation in April 2006 heralded an exciting new era in state health policy. The reform plan is the most comprehensive effort by a state to achieve near-universal coverage, and arguably the most controversial, given its inclusion of an individual mandate.

The Massachusetts individual mandate, in effect since 2007, requires state residents to maintain MCC or face a potential state tax penalty. Providing MCC is not an employer mandate, but many employees use employment-based health coverage to satisfy the individual mandate.

The number of hours one PCA can work providing MassHealth PCA services is limited to 50 hours each week unless you are approved to schedule that one PCA to work more than 50 hours each week. The 50 hour limit applies if the PCA works for you, or for you and other members.

MassHealth's Personal Care Attendant (PCA) program helps people with permanent or chronic disabilities keep their independence, stay in the community, and manage their own personal care by providing funds and other supports for hiring PCAs.

In Massachusetts, Medicaid and the Children's Health Insurance Program (CHIP) are combined into one program called MassHealth. MassHealth members may be able to get doctors visits, prescription drugs, hospital stays, and many other important services.
