Marriage licenses are issued Monday through Friday, from am to pm at the Clerk's Office where it will take approximately 10 to 15 minutes to complete the form at our Marriage Computer Kiosk followed by a review of the application and administration of the required oath by a member of our staff.
Both parties must be present to apply for a marriage license. You must both be at least 18 years of age and present valid government issued identification that is not expired (ie; passport, driver's license, id card). If an interpreter is needed, you should bring one with you. Neither party can interpret for the other.
To obtain a divorce in Virginia, either you or your spouse must be a resident of Virginia for at least six months prior to filing for divorce. If there are no children from the marriage, you must be separated for a minimum of six months and have a written property settlement agreement before you may file for divorce.
How long does it take? The whole marriage licence application process can take as little as 20 minutes! But plan a little extra to park and to take your time filling out the forms. Some Circuit Court Clerk's Offices even have the application online for you to fill out ahead of time to make this process even faster.
By filing first, you may feel more prepared and find yourself less surprised by the litigation. Men often report that they feel surprised. But, again, that's not a legal upper hand.
Virginia doesn't do courthouse weddings. Most officiants in the area will meet you just about anywhere to officiate your vows and sign the paperwork. Some limit themselves to an office, but many will travel to meet you or have a regular schedule at park locations. Just depends on who you contact!
