Under the Federal Rule of Evidence (often referred to as the FRE) section 609, prior criminal convictions can only be used if the conviction was punishable by more than one year in prison, and the value of the evidence does not result in an unfair advantage to the prosecution.

New South Wales In relation to NSW convictions, a conviction generally becomes a spent conviction if a person has had a 10 year crime-free period from the date of the conviction. However, certain convictions may not become spent.

Generally, prosecutors can't use evidence of prior convictions to prove a defendant's guilt or tendency to commit crimes, but they can sometimes use them to question the truthfulness or credibility of the defendant's testimony.

Does a Felony Ever Go Away? A felony charge will stay on your record for life. The only way to remove a felony from your record is through a strict process called expungement (more on expungement below).

Testifying as a witness does not give rise to any record other than the fact that your testimony was recorded in the case in which you testify. There is no "central registry" of witness who have testified.

Criminal records stay with you for life. They do not automatically disappear, not after several years and not for minor offences. Except in a few cases, you may apply for a record suspension (pardon) if you want the RCMP to keep your record separate from other criminal records so that the information is not accessible.

Criminal convictions become 'spent' after a certain amount of time.Until this rehabilitation period is complete, the conviction is 'unspent'. Some jobs may require your potential employer to apply for a DBS check on your behalf. If you have unspent convictions, they will show up on any level of disclosure.

In general, background checks typically cover seven years of criminal and court records, but can go back further depending on compliance laws and what is being searched.
