Substitution of Counsel is the process of replacing one attorney with another in a legal case. This may occur for a variety of reasons, including the attorney's withdrawal from the case, a change in the client's needs or interests, or a conflict between the attorney and the client. Generally, the client must agree to the change in order for the substitution to take place. There are two main types of Substitution of Counsel: voluntary and involuntary. Voluntary Substitution of Counsel occurs when both the attorney and the client agree to the change, while involuntary Substitution of Counsel is initiated by the court and generally requires the court’s approval.
