A South Carolina Notice of Appeal is a legal document that is required to be filed with the South Carolina Court of Appeals when a party is appealing a decision made in a lower court. The notice of appeal must be filed within thirty days of the entry of the lower court’s final judgment or order being appealed. The notice of appeal outlines the parties involved in the case, the lower court order or judgment that is being appealed, the grounds for the appeal, and the relief sought. There are two types of South Carolina Notice of Appeal: a Notice of Appeal of Right and a Notice of Discretionary Appeal. A Notice of Appeal of Right must be filed when the lower court ruling is being appealed on the grounds of an erroneous application of law, an erroneous interpretation of the law, or an erroneous application of the facts. A Notice of Discretionary Appeal must be filed when the lower court ruling is being appealed on any other grounds, such as an abuse of discretion.
