Rhode Island Deferred Sentence Agreement is an agreement between a criminal defendant and a prosecutor that allows the defendant to receive a reduced sentence or no sentence at all in exchange for the defendant’s agreement to complete certain terms and conditions. There are two types of Rhode Island Deferred Sentence Agreements: Deferred Sentence Agreement (DSA) and Deferred Judgment and Sentence Agreement (JSA). Under a DSA, the defendant agrees to plead guilty or no contest in exchange for the prosecutor’s agreement to defer imposition of sentence for a set period of time. If the defendant successfully completes the terms of the agreement, the court will not impose a sentence. Under a JSA, the defendant pleads guilty or no contest to the charges, but the court does not enter a judgment of guilt. Instead, the court defers the decision on the defendant's guilt or innocence until the defendant has completed the terms of the agreement. If the defendant successfully completes the terms of the agreement, the court may then enter a judgment of innocence.
