Rhode Island Small Claims Notice of Suit-Answer is a form used by defendants to respond to a small claims action in the Rhode Island court system. The Notice of Suit-Answer informs the defendant of the plaintiff's claim and allows them to contest or accept the claim. The defendant must file a written answer within twenty days of receiving the notice in order to contest the claim. There are three types of Rhode Island Small Claims Notice of Suit-Answer: 1) Defendant's Answer; 2) Defendant's Counterclaim; and 3) Defendant's Motion to Dismiss. The Defendant's Answer is used to contest the plaintiff's claim and must include specific facts and legal arguments in denial of the plaintiff's claim. The Defendant's Counterclaim is used to assert a claim against the plaintiff in response to the plaintiff's claim. The Defendant's Motion to Dismiss is used to request that the court dismiss the plaintiff's claim for lack of jurisdiction or other legal grounds.
