Oregon Chapter 13 Plan [Use w/ Case Filed On/After 06/01/14, but Prior to 12/01/17] is a form of debt relief that helps debtors reorganize their finances and pay back creditors over a 3 to 5-year period. This type of bankruptcy plan requires the debtor to make regular payments to the bankruptcy trustee who, in turn, distributes the payments to creditors according to the plan. The plan must be accepted by the creditors and approved by the court in order for it to be implemented. There are two types of Oregon Chapter 13 Plans that can be used with cases filed on or after June 1, 2014, but prior to December 1, 2017. The first type is the “Standard Plan” which is available to debtors with regular income and who do not have debts that exceed the limits set by the Bankruptcy Code. The second type is the “Extended Plan” which is available to debtors with irregular income, debts that exceed the limits set by the Bankruptcy Code, or special circumstances. Both plans allow debtors to keep their assets, such as homes and cars, while making payments to creditors. The payments are based upon the debtor's income, the amount of debt, and the amount of assets. The debtor's disposable income will be used to pay off creditors over the course of the plan. Once the plan is completed, the debtor's remaining debts are discharged.
