Oklahoma Malicious Prosecution-Probable Cause refers to a cause of action available to an individual who has been wrongfully prosecuted for a crime. In order to establish a claim for malicious prosecution-probable cause, the plaintiff must show that the defendant initiated or procured criminal proceedings against the plaintiff, the proceedings were terminated in favor of the plaintiff, the defendant acted with malice, the defendant lacked probable cause to prosecute the plaintiff, and the plaintiff suffered damages as a result of the wrongful prosecution. There are two types of malicious prosecution-probable cause claims available in Oklahoma: intentional malicious prosecution-probable cause and negligent malicious prosecution-probable cause. Intentional malicious prosecution-probable cause occurs when the defendant acted with intent to cause the wrongful prosecution of the plaintiff, while negligent malicious prosecution-probable cause occurs when the defendant acted without reasonable care in initiating or procuring the prosecution of the plaintiff.
